Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Drafft AI platform, website, and related services (collectively, the “Service”) operated by Drafft AI, Inc. (“Drafft AI,” “we,” “our,” or “us”), a Delaware corporation. By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing our platform, or using any part of our Service, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to these Terms and our Privacy Policy.
2. Description of Service
Drafft AI provides an AI-powered fleet intelligence platform that connects to your telematics providers and fuel cards to deliver fuel stop recommendations, idle time monitoring, route optimization insights, and ELD safety data aggregation.
3. Account Registration
You must create an account to access most features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. Subscriptions and Payment Terms
Access to the Drafft AI platform is provided on a subscription basis. Subscription fees are charged monthly per truck in your connected fleet. All fees are non-refundable except where required by applicable law.
5. Authorized Use
You may use the Service only for lawful commercial fleet management purposes. You agree not to reverse engineer the platform, use the Service to compete with Drafft AI, resell access, or violate applicable law including FMCSA rules.
6. Third-Party Integrations
The Service integrates with third-party platforms including Samsara, Motive, Geotab, WEX, Comdata, and RTS. Your use of these integrations is subject to the terms of those providers.
7. Intellectual Property
The Service, including all software, algorithms, designs, and content, is owned by Drafft AI. You retain ownership of your fleet data and grant us a limited license to process it solely to provide the Service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. DRAFFT AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. FUEL STOP RECOMMENDATIONS ARE ADVISORY ONLY.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAFFT AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Drafft AI from any claims arising out of your use of the Service or violation of these Terms.
11. Termination
Either party may terminate these Terms at any time. You may cancel your subscription through your account settings. Upon termination, your right to use the Service ceases immediately.
12. Governing Law
These Terms are governed by the laws of the State of Delaware. Disputes shall be resolved through binding arbitration in accordance with the AAA Commercial Arbitration Rules.
13. Changes to Terms
We may modify these Terms at any time with at least 14 days notice. Continued use constitutes acceptance.
